PA Health Policy Update for October 3

The following is an update of selected state health policy developments in Pennsylvania from September 29- October 3 (Some of the language used below is taken directly from state documents).

Budget Update 

As the state budget impasse continues on, with added pressure of a federal shutdown, this week the House positioned a budget bill, SB 160, into the House Appropriations Committee for future potential action. Additionally, the House amended HB 1331, Capital Debt Itemization legislation, with additional capital projects for future consideration.

General Assembly 

Both the House and Senate will return for voting session beginning on Monday, October 6th, the first time both chambers will be in voting session together since June.  For the week ahead, the following hearings and voting meetings are scheduled:

  • On Monday, the House Aging & Older Adult Services Committee will hold a voting meeting on Chairwoman Maureen Madden and Chairman Steve Mentzer’s HB 1894, legislation which would enhance educational efforts for the LIFE program during the Medicaid long-term care enrollment process. The committee will also consider HB 1528, Grandfamilies Assistance legislation to benefit grandparents raising grandchildren.
  • On Tuesday, the House Insurance Committee will meet to consider HB 1828 which would set into law the Governor’s recent actions requiring private insurance coverage of vaccines without cost-sharing that are FDA-approved and recommended by the American Academy of Pediatrics (AAP), the American College of Obstetricians and Gynecologists (ACOG), the American College of Physicians (ACOP), or the American Academy of Family Physicians (AAFP) according to their immunization schedules. The committee will also consider HB 1123, updating the recommended age for insurance coverage of colorectal cancer screenings from 50 to 45.
  • On Wednesday, the House Professional Licensure Committee will consider adding a pharmacy technician and a second acute care institutional pharmacist to the State Board of Pharmacy through HB 980. Also, the committee will also consider HB 1881 which would guarantee that Pennsylvania pharmacists’ vaccination practice authority can be guided by recommendations from Pennsylvania’s health authorities that may be informed by our state’s professional medical societies.

Below are some health care-related legislation introduced or co-sponsorship memos circulated this week:

  • Rep. Marla Brown circulated a co-sponsor memo for legislation to remove staffing ratios for nursing homes in Pennsylvania.
  • Sen. Judy Ward released a co-sponsor memo on legislation to address lags in MA enrollment in long-term care.
  • Sen. Cris Dush filed SB 125 proposing a Constitutional Amendment giving the General Assembly the authority to establish laws on venues for civil litigation in the Commonwealth as a way to address venue shopping in malpractice cases.

Department of Human Services

The Department of Human Services (DHS) has shared an update for Community Service Support Provider fee-for-service rates for the start of the new federal fiscal year.

Department of Health 

The Department of Health (DOH) issued a health alert with recommendations for health care providers to take in preparation for the 2025-2026 Respiratory Season, including details on reporting requirements. The Department also updated its Respiratory Virus Outbreak Toolkit, which gives recommendations to long-term care facilities on how to prepare for and respond to outbreaks of influenza, RSV, COVID-19, adenovirus, and more.

Independent Regulatory Review Commission 

The Independent Regulatory Review Commission (IRRC) approved final regulations from the State Board of Nursing making additions to the continuing education requirements for certified registered nurse practitioners (CRNP) and registered nurses (RN) in the areas of opioid prescriptions and organ donation.

Around the State  

On Thursday, Governor Shapiro signed an Executive Order at the Children’s Hospital at Philadelphia directing the Department of Health to develop a plan to preserve access for children in the Vaccines for Children program without cost sharing if future Advisory Committee on Immunization Practices (ACIP) changes impact access, aligning vaccine guidance with American Academy of Family Physicians (AAFP), American College of Obstetricians and Gynecologists (ACOG), and American Academy of Pediatrics (AAP), creating a website for vaccine information and guidance, ensuring insurance coverage without prior authorizations or cost sharing, among other points.

PA Health Policy Update for September 26

The following is an update of selected state health policy developments in Pennsylvania from September 22- 26 (Some of the language used below is taken directly from state documents).

Budget Update 

The state budget impasse continues to drag on. This week, the Senate was not in session but the House met for non-voting session. The Senate has scheduled a non-voting session day on October 3rd and voting session on October 6th through 8th. As highlighted in this Penn Capital Star article, with transit funding handled through other means, counties and schools will become the pressure point as negotiations continue.

Treasurer Stacy Garrity announced the creation of a $500 million loan fund for counties and Head Start providers as a bridge for funding through the budget stalemate.

General Assembly

The House will return for voting session beginning on Monday, September 29th.  For the House session week ahead, the following hearings and voting meetings are scheduled:

  • Monday, Sept. 29, 9:30am – The House Aging & Older Adult Services Committee will hold an informational meeting on the PA CareKit Program. The Department of Aging will offer testimony.
  • Monday, Sept. 29, 10:45am – House Human Services Committee will meet to consider HR 290, a resolution recognizing the month of September 2025 as “National Recovery Month” in Pennsylvania.
  • Tuesday, Sept. 30, 10am – The House Consumer Protection, Technology, and Utilities Committee will hold a voting meeting to consider HB 1530 which would create privacy and transparency requirements genetic data collected through direct-to-consumer genetic testing.
  • Tuesday, Sept. 30, off-the-floor – The House Health Committee will hold a voting meeting on the following legislation:
  • HB 880 – Updating and closing loopholes within Pennsylvania’s Clean Indoor Air Act.
  • HR 271 – A Resolution directing the Joint State Government Commission to establish an advisory committee and conduct a comprehensive study regarding the indoor air quality for seniors and children in this Commonwealth.

Below is some health care-related legislation introduced or co-sponsorship memos circulated this week:

  • Arvind Venkat introduced HB 1881 which would guarantee that Pennsylvania pharmacists’ vaccination practice authority can be guided by recommendations from Pennsylvania’s health authorities that may be informed by our state’s professional medical societies.
  • Rich Irvin filed a co-sponsor memo which proposed transferring the pharmacy delivery model in Medical Assistance (MA) from Managed Care back to a Fee-For-Service model as a means to impact reimbursements for pharmacies.
  • Cris Dush filed a co-sponsor memo proposing a Constitutional Amendment giving the General Assembly the authority to establish laws on venues for civil litigation in the Commonwealth as a way to address venue shopping in malpractice cases.
  • Lynda Schlegel Culver filed a co-sponsor memo to provide MA coverage for rapid whole genome sequencing (rWGS) for critically ill infants up to one year of age who are admitted to an inpatient intensive care unit with a complex illness.
  • Senators Michele Brooks and Lisa Boscola filed a co-sponsor memo for a resolution urging Congress to provide Pennsylvania with any and all assistance to help comply with the recent federal changes following the One, Big, Beautiful Bill Act.

Department of Human Services

The Department of Human Services (DHS) issued guidance to providers related to “Date of Death Recovery” following a recent audit noting recipient date of death discrepancies where recipients were deceased prior to the dates of service being billed.

DHS’ Office of Developmental Programs issued guidance for flu, RSV, and COVID vaccinations.

Department of Health 

The Department of Health (DOH) issued general immunization guidance to clinicians in response to last week’s federal ACIP meeting. The list clarifies organizations for doctors and families to consult on vaccine recommendations.

DOH issued a health alert to providers with guidance on when and how to exclude health care personnel from direct patient care when they are experiencing respiratory illness symptoms.

DOH reminded long-term care facility providers that the annual long-term care questionnaire is due by October 24. Facilities were contacted directly with instructions to complete the web-based questionnaire. Insurance Department

The Pennsylvania Insurance Department has confirmed the private insurance companies operating in the Commonwealth will continue to cover all of the vaccines covered under ACIP’s 2024 recommendations.

A group of statewide researchers have compiled a website which aims to track opioid settlement fund spending data in Pennsylvania, which is driven out primarily through counties.

PA Health Policy Update for July 11

The following is an update of selected state health policy developments in Pennsylvania from July 7 – July 11.  (Some of the language used below is taken directly from state documents). 

Fiscal Year 2025-26 Budget Update 

Governor Shapiro and legislative leaders continue to meet and negotiate in an attempt to reach a final agreement on the commonwealth’s Fiscal Year (FY) 2025-2026 spending plan, which is 11 days overdue. As discussions continue, the Senate is recessed until the call of the chair and the House is currently scheduled to return to session on Monday, July 14. 

Governor Shapiro 

Governor Shapiro signed the following bills into law this week.

  • House Bill 309, now known as Act 29 of 2025, amends the Osteopathic Medical Practice Act to allow team physicians traveling internationally with their club or national team to treat their own players on site during games without needing a Pennsylvania medical license.
  • Senate Bill 95, now known as Act 34 of 2025, permits EMS providers to leave naloxone with a caregiver of a patient who overdosed. The bill also places certain disclosure requirements on pharmacies related to the retail and generic versions of prescribed medications and allows for the provisional licensing of pharmacists. 

The Shapiro administration has announced that Pennsylvania is a full participant in three multistate licensure compacts that will streamline the licensure process for physicians, nurses, and physical therapists. 

General Assembly

The state House of Representatives convened in Harrisburg this week. The following is an overview of selected health care-related legislative activity that occurred.

  • The House of Representatives passed House Bill 1697 by a vote of 136-67. House Bill 1697 establishes a state level false claims act. The bill will now be sent to the Senate for consideration.
  • The House of Representatives passed House Bill 80, which authorizes the commonwealth to join the Audiology & Speech-Language Pathology Interstate Compact. The bill will now be sent to the Senate for consideration.

The House of Representatives is currently scheduled to return to session on Monday, July 14. The Senate is recessed until the call of the chair.

Department of Human Services 

The Department of Human Services (DHS) has announced that it experienced a delay in implementing Version 42 of the APR DRG classification system for Medical Assistance (MA) enrolled acute care general hospitals. As a result of the delay, DHS will begin to mass adjust claims submitted for discharge dates October 1, 2024 through June 6, 2025. Find additional information in Provider Quick Tip #275.

DHS has announced it will hold another listening session in its “Food is Medicine Stakeholder Engagement Series,” which is part of the Bridges to Success: Keystones of Health demonstration waiver. The next session, which will focus on pregnancy food boxes, will take place on June 21 at 1:00 p.m. Find additional information and registration details here. 

Department of Community & Economic Development

The Department of Community & Economic Development (DCED) has announced it will publish its draft action plan for the 2024 Allocation of Recovery Housing Program for public review and comment beginning July 12. The federal Department of Housing and Urban Development awarded Pennsylvania $1.2 million of Recovery Housing Program funds, which will be administered by DCED. The purpose of the program is to help grantees to provide stable, temporary housing to individuals in recovery from a substance disorder. Spotlight PA has published an article about the potentially negative impacts the federal reconciliation package passed by Congress and signed into law by President Trump will have on access to rural health care.

The Philadelphia Inquirer has written a piece about the Pennie, Pennsylvania’s state-based insurance marketplace, and the impact on enrollment if Congress doesn’t extend the enhanced tax credit subsidies.

The WIC State Advisory Board has announced its next regular meeting of the board will be held on July 22 from 1:00 p.m. to 2:00 p.m. The purpose of this meeting is to collaborate to gather suggestions of strategies for increasing participation and improving the WIC program to better support participants. PA Health Policy Update for June 27

The following is an update of selected state health policy developments in Pennsylvania from June 23 – 27.  (Some of the language used below is taken directly from state documents). 

General Assembly

The state House of Representatives and Senate convened in Harrisburg this week. The following is an overview of selected health care-related legislative activity that occurred.

  • The Senate unanimously voted to concur with the House’s amendments to Senate Bill 411, which provides the ability for the Pennsylvania Department of Health to create and utilize a stroke registry. The bill will now be sent to Governor Shapiro’s desk for his signature.
  • The Senate unanimously passed House Bill 640, which updates annual reporting requirements for the Department of Drug & Alcohol Programs (DDAP). The amended bill will now be sent back to the House for concurrence.
  • The Senate unanimously passed House Bill 309, which amends the Osteopathic Medical Practice Act to allow team physicians traveling internationally with their club or national team to treat their own players on site during games without needing a Pennsylvania medical license. The amended bill will now be sent back to the House for concurrence.
  • The Senate passed Senate Bill 715, which extends the Rare Disease Advisory Council’s sunset date to 2028. The bill was subsequently sent to the House and referred to the Health Committee.
  • The Senate passed Senate Bill 88, which provides coverage for supplemental screenings and diagnostic examinations without cost-sharing if a patient is at average risk or higher for breast cancer. The bill was subsequently sent to the House and favorably reported out of the Insurance Committee.
  • The House of Representatives passed House Bill 1100, which creates a grant program to provide eligible public-school entities with funding to acquire and distribute menstrual hygiene products. The bill will now be sent to the Senate for consideration.
  • The House of Representatives passed House Bill 1445, which prohibits an insurer from denying what would otherwise be a service covered by the policy simply because the health care service was received in a school setting. The bill was subsequently sent to the Senate and referred to the Banking & Insurance Committee.
  • The House of Representatives passed House Bill 1590, which supports Pennsylvania’s implementation of a new federal Medicaid flexibility that waives the longstanding “four walls” requirement for outpatient behavioral health clinics. The bill will now be sent to the Senate for consideration.
  • The House of Representatives passed House Bill 583, which requires the Department of Human Services to establish a benefit package for dental services for Medicaid. The bill was subsequently sent to the Senate and referred to the Health & Human Services Committee.
  • The House of Representatives passed House Bill 1442, which places requirements on coroners to report Sudden Unexpected Death in Epilepsy (SUDEP). The bill was subsequently sent to the Senate and referred to the Local Government Committee.

The House and Senate will reconvene on Monday, June 30 for voting session.

Department of Human Services

  • The Department of Human Services (DHS) has issued a Medical Assistance Bulletin to notify providers that it will begin using Milliman Clinical Guidelines (MCG) as the screening guidelines to determine medical necessity for services, items, procedures, or level of care provided to Medical Assistance (MA) beneficiaries, effective July 18, 2025. 
  • DHS has also issued a Medical Assistance Bulletin to advise providers of changes to the MA program fee schedule. The department is adding and end-dating codes as a result of the 2025 updates published by the Centers for Medicare & Medicaid Services to the Healthcare Common Procedure Coding System (HCPCS). The changes are effective for dates of service on and after June 16, 2025. 
  • DHS has announced the proposed assessment amount, the proposed assessment methodology, and the estimated aggregate impact on nursing facilities that will be subject to the assessment under the Nursing Facility Assessment Program beginning in Fiscal Year (FY) 2025-2026.   • The Office of Long-Term Living (OLTL) has shared an alert from the Centers for Medicare & Medicaid Services (CMS) about a fraud scheme that uses phishing fax requests, which falsely claim to be from CMS staff, to obtain medical records and documentation for auditing purposes.

Department of Health

The Department of Health (DOH), in partnership with the Pennsylvania Insurance Department and the Department of Human Services has launched a public survey looking for feedback on and suggestions for improving women’s health care across the commonwealth. The 10-minute survey is open through July 7 and focuses on women’s preventive health care, like health screenings, birth control, pregnancy care, and mental health services. 

Independent Fiscal Office

The Independent Fiscal Office (IFO) has published a revised document updating its prior impact of the Medicaid provisions included in the federal reconciliation bill package being negotiated by the U.S. Congress. 

Department of State 

The Department of State has announced that Pennsylvania will become a full participant in three health care compacts – physician, nursing, and physical therapy – beginning July 7. Click the respective compact link for more information regarding its implementation. 

Department of Aging

The Department of Aging has announced that it is conducting an evaluation of the PA Link to inform the design of a strategic plan to refresh and improve the program to better serve older adults, people with disabilities, and caregivers. State Board of Nursing 

The State Board of Nursing has released proposed regulations implementing Act 60 of 2021, which establishes title protection for certified registered nurse anesthetists (CRNA). Find the proposed rulemaking in this Pennsylvania Bulletin notice.

State Board of Pharmacy 

The State Board of Pharmacy has issued final-form rulemaking to effectuate Act 140 of 2020, which establishes criteria for pharmacy technician training programs as well as the standards of practice and registration fees for both pharmacy technicians and pharmacy technician trainees. PA Health Policy Update for June 20

The following is an update of selected state health policy developments in Pennsylvania from June 16 – 20.  (Some of the language used below is taken directly from state documents). 

Governor Shapiro 

The Shapiro administration has shared a document with stakeholders outlining the potential impact of H.R. 1, the reconciliation package currently being considered by the U.S. Congress. The assessment primarily addresses the impact on Medicaid coverage. It does not include a detailed overview of the provisions in the reconciliation package related to provider taxes or state directed payments, from which Pennsylvania receives significant funding. 

General Assembly

The state House of Representatives convened in Harrisburg this week. The following is an overview of selected health care-related legislative activity that occurred.

  • The House Health Committee met on Monday, June 16 and favorably reported, among other bills, House Bill 1234, which expands the Medical Assistance program to cover blood pressure monitors for home use as a pregnancy-related service on a per pregnancy basis. 
  • The House Professional Licensure Committee met on Tuesday, June 17 and favorably reported House Bills 80 and 482, which enable Pennsylvania to join the Audiology and Speech-Language Pathology Interstate Compact and the National Occupational Therapy Licensure Compact respectively, and Senate Bill 115, which requires the Department of Human Services to offer a skills competency exam in lieu of  high school diploma or GED requirements for individuals seeking employment as direct care staff in personal care homes or assisted living residences. 
  • The House Insurance Committee met on Tuesday, June 17 and favorably reported House Bill 1445, which prohibits an insurer from denying what would otherwise be a service covered by the policy simply because the health care service was received in a school setting. 

The state House of Representatives and Senate will reconvene in Harrisburg for voting on Monday, June 23.

Department of Human Services 

The Department of Human Services (DHS) has announced the proposed annual case-mix per diem payment rates for state Fiscal Year (FY) 2025-26 for non-public and county nursing facilities that participate in the Medical Assistance (MA) program. DHS has issued Provider Quick Tip #263 regarding the electronic submission process for Office of Medical Assistance Programs’ (OMAP) fee-for-service (FFS) and the Office of Long-Term Living’s (OLTL) and LTC 180-day exception requests and other claims requiring documentation in the Promise Portal. 

Department of Health

The Department of Health (DOH) has announced the Newborn Screening and Follow-up Technical Advisory Board is adding Metachromatic Leukodystrophy (MLD) screening, effective January 1, 2026, to the supplemental conditions mandated for screening and follow-up by commonwealth submitters and follow-up by the commonwealth newborn screening program. Independent Fiscal Office 

The Independent Fiscal Office (IFO) has published a document outlining the impact of the Medicaid provisions included in the federal reconciliation bill passed by the U.S. House of Representatives. The document also includes a budget brief highlighting Pennsylvania Medicaid enrollment and funding trends from FY 2018-19 through the Shapiro administration’s proposal for FY 2025-26. 

Insurance Department 

The Pennsylvania Insurance Department (PID) has announced that most health insurers are requesting significant premiums increases for plan year 2026. On average, insurers are asking for a 19 percent increase to premiums in the individual market, and a 13 percent increase to premiums in the small group market.

  • State Senate Majority Leader Joe Pittman (R-Indiana) has stated he, “sees no practical way that a budget will be completed on June 30.” His comments and the significant increase in funding for the Medicaid program were the subject of an article by the Pennsylvania Capital-Star. 
  • The Pew Charitable Trusts has published an article about the share of state budgets spent on Medicaid and which states have increased their own resources on Medicaid.
  • A CBS3 report has highlighted insurance denials and called attention to the Pennsylvania Insurance Department’s external review process for claim denials.

PA Health Policy Update for June 6

The following is an update of selected state health policy developments in Pennsylvania from June 2 – 6.  (Some of the language used below is taken directly from state documents). 

General Assembly

The state House of Representatives and Senate convened in Harrisburg this week. The following is an overview of selected health care-related legislative activity that occurred this week.

  • The Senate passed Senate Bill 411, which provides the ability for the Pennsylvania Department of Health to create and utilize a stroke registry. The bill will now be sent to the House for consideration.
  • The House of Representatives passed House Bill 704, which establishes the “Pennsylvania Neurodegenerative Disease Research Program.” The bill will now be sent to the Senate for consideration.
  • The House of Representatives passed House Bill 668, which authorizes Pennsylvania to join the National Counseling Compact. The bill will now be sent to the Senate for consideration.
  • The House of Representatives also passed House Bill 554, which authorizes Pennsylvania to join the Social Work Licensure Compact. The bill will now be sent to the Senate for consideration.
  • The House of Representatives passed House Bill 1140, which expands access to contraceptives. The bill will now be sent to the Senate for consideration.
  • The House of Representatives passed House Bill 282, which authorizes the Department of Corrections (DOC) to establish a medical assistance (i.e., Medicaid) reentry program for incarcerated individuals who are scheduled to be released and returning to the community. The bill will now be sent to the Senate for consideration.
  • The House Aging & Older Adult Services Committee met on Monday, June 2 for a public hearing on House Bill 1310, which establishes a minimum budget adjust factor (BAF) floor at $0.90 for skilled nursing facilities. A recording of the meeting is viewable here.
  • The Senate Consumer Protection & Professional Licensure Committee met on Tuesday, June 3 and favorably reported, among other bills, Senate Bill 583, which authorizes the state to enter the Social Work Licensure Compact, and Senate Bill 604, which authorizes the state to join the National Counseling Compact.   • The House Health Committee met on Tuesday, June 3 and favorably reported the following bills. A recording of the meeting is viewable here.
    • House Bill 425, which establishes a J-1 visa waiver primary care physician grant program.
    • House Bill 583, which requires the Department of Human Services to establish a benefit package for dental services for Medicaid.
    • House Bill 1460, which provides for more oversight of health care entity merger and acquisition activities.  
  • The House Human Services Committee met on Wednesday, June 4 and favorably reported two suicide prevention related bills, House Bill 415 and House Bill 564. A recording of the meeting is viewable here. 

The state House and Senate will return to Harrisburg next Monday, June 9 through Wednesday, June 11 for voting session.

Department of Human Services 

  • The Department of Human Services (DHS) has announced it will hold another listening session in its “Food is Medicine Stakeholder Engagement Series,” which is part of the Bridges to Success: Keystones of Health demonstration waiver. The next session, which will focus on medically tailored meals, will take place on June 16 at 1:00 p.m. Find additional information and registration details here.
  • The Office of Mental Health & Substance Abuse Services (OHMSAS) has announced it will pause the implementation of OMHSAS-25-02 Voluntary and Involuntary Commitment Forms for 90 days in response to concerns raised by stakeholders. In addition to giving providers the opportunity to update electronic health records and print new forms, OMHSAS will use the time to continue to receive and respond to stakeholder questions and to schedule Q&A sessions. 
  • DHS has issued a Request for Applications (RFA) for organizations to provide community health worker services to reduce barriers to care for individuals living within the North Philadelphia Health Enterprise Zone (HEZ). The HEZ was established in 2017 and encompasses 15 zip codes in the region. Up to six selected organizations can receive up to $500,000 per year for two years to increase CHW capacity and deploy innovative care management programs within the HEZ. Applicants shall be a 501(c)(3) charitable organization or have an association with a national charitable organization. However, applicants may not be owned, operated, or controlled by a hospital, institution of higher education, or managed care organization (MCO). For more information, see the RFA here.

Department of Health

The Department of Health (DOH) has launched a public survey looking for feedback on and suggestions for improving women’s health care across the commonwealth. The 10-minute survey is open through July 7 and focuses on women’s preventive health care, like health screenings, birth control, pregnancy care and mental health services.

DOH has announced it will make copies of the proposed Preventative Health and Health Services Block Grant Application for Federal Fiscal Year 2025 available for public review. The department has also announced it will hold a virtual public hearing on June 17 from 1:00 p.m. to 2:00 p.m. to receive public input on the block grant application. Independent Regulatory Review Commission  

The Independent Regulatory Review Commission (IRRC) has announced it received the Department of Human Services’ (DHS) regulation regarding the transition to the Patient-Driven Payment Model (PDPM). IRRC will consider the regulation at its June 26 public meeting. 

Revenue Collection Update 

The Department of Revenue has announced that Pennsylvania collected $3.2 billion in General Fund revenue in May, which was $66.3 million, or 2.0 percent, less than anticipated. Fiscal year-to-date General Fund collections total $42.7 billion, which is $262.5 million, or 0.6 percent, above estimate.

  • The Pennsylvania Capital-Star has written an article about pharmacists’ call for additional regulation of pharmacy benefit managers amid increasing closures of pharmacies across the state.

General Assembly

The state House of Representatives and Senate convened for voting session this week. The following is an overview of selected legislative activity that occurred.

  • The House of Representatives passed House Bill 1200, which legalizes and regulates adult-use cannabis, by a party-line vote of 102 – 101. The bill will now be sent to the Senate for consideration.
  • The House of Representatives passed House Bill 926, which seeks to prevent health care workplace violence by placing several requirements on health care facilities, by a vote of 124 – 79. The bill will now be sent to the Senate for consideration.
  • The House of Representatives passed House Bill 1117, which updates language defining DDAP’s duties and responsibilities. The bill will now be sent to the Senate for consideration.
  • The Senate passed Senate Bill 115, which requires the Department of Human Services to offer a skills competency exam in lieu of  high school diploma or GED requirements for individuals seeking employment as direct care staff in personal care homes or assisted living residences. The bill will now be sent to the House of Representatives for consideration.

Department of Human Services 

The Department of Human Services (DHS) has announced it will hold a listening session on May 19 from 1:00 – 2:30 p.m. entitled, “Food is Medicine: Screening and Referral.” This is part of DHS’ Keystone of Health Section 1115 demonstration waiver initiative. The listening session is intended for representatives from health care and other settings that interact with consumers that may be eligible for Food is Medicine programs. Department of Aging  

The Department of Aging has announced a 30-day public comment period on its updated Intrastate Funding Formula (IFF), which is used to distribute federal funding to the commonwealth’s 52 Area Agencies on Aging.   • The House of Representatives passed House Bill 640, which updates annual reporting requirements for the Department of Drug & Alcohol Programs (DDAP). The bill will now be sent to the Senate for consideration.
  • The House of Representatives passed House Bill 409, which requires health care providers to inform patients that they will be receiving their test results in their electronic health record, or that they can request to receive the results in the mail. The bill will now be sent to the Senate for consideration.
  • The House Aging & Older Adult Services Committee held an informational meeting on Monday, April 7 to examine potential updates to the Older Adult Protective Services Act (OAPSA). A recording of the meeting is viewable here.
  • The House Human Services Committee met on Tuesday, April 8 and favorably reported House Bill 561, which expands Act 80 to include all FDA-approved medication assisted treatment, and House Bill 1117, which updates language defining DDAP’s duties and responsibilities.     • House Bill 69, which expands the existing Cancer Drug Repository program to other prescription drugs.

The House of Representatives and the Senate have now recessed. The House will reconvene Tuesday, April 22 and the Senate will reconvene Monday, May 5. 

Department of Human Services 

  • The Department of Human Services (DHS) has issued a Medical Assistance Bulletin to remind physicians, physician assistants (PAs), and certified registered nurse practitioners (CRNPs) enrolled in Medicaid that they are able render topical fluoride varnish (TFV) services to Medicaid beneficiaries.
  • DHS has issued a reminder to all participating Medicaid providers of the need to complete a “MA 112 Form” after the birth of a child to a mother enrolled in Medicaid in order to notify the mother’s respective county assistance office (CAO).  The “MA 112 Form” should be completed and submitted within three working days of the child’s birth.
  • DHS has published final notice of its funding allocation for FY 2024-25 for several classes of inpatient disproportionate share hospital (DSH) and supplemental payments to Medicaid-enrolled, qualifying inpatient acute care general hospitals. Governor Shapiro

The Shapiro administration has announced it joined a multi-state lawsuit against the Trump administration’s decision to cancel more than $500 million in public health grant funding that supported programs in the Department of Health, Department of Human Services, and the Department of Drug & Alcohol Programs. General Assembly

The state Senate convened in Harrisburg this week. The following is an overview of selected health care-related legislative activity.

  • The Senate passed Senate Bill 347, which prohibits the implementation of safe injection sites throughout the commonwealth, by a vote of 38-11. The bill will now be sent to the House of Representatives for consideration.
  • The Senate Institutional Sustainability & Innovation Committee held an informational hearing on Tuesday, April 1 examining the commonwealth’s life science sector and Pennsylvania’s innovation economy. A recording of the hearing is and testimony offered to the committee is viewable here.
  • The Senate Health & Human Services Committee held a voting meeting on Tuesday, April 1 and favorably reported, among other bills, Senate Bill 115, which provides skills competency examination opportunities to individuals seeking employment as a direct caregiver in lieu of successfully obtaining a high school diploma or GED equivalency, and Senate Bill 411, which implements a statewide stroke registry.

Department of Human Services

The Department of Human Services (DHS) has issued a Medical Assistance Bulletin to advise providers that DHS is implementing an alternative payment methodology for federally qualified health centers (FQHCs) and rural health clinics (RHCs) for a supplemental payment at the Medicaid fee schedule rate for a long-acting reversible contraceptive (LARC) device and its insertion, or the removal of a LARC device.

DHS has announced a recent audit uncovered recipient date of death discrepancies and a claims recovery was completed to recoup monies paid in error. DHS also reminded providers that it is their responsibility to resubmit a correctly completed claim if they are due payment for services provided prior to the date of death.  Find the notice here. 

Revenue Collection Update  

The Department of Revenue has announced Pennsylvania collected $6.2 billion in General Fund revenue in March, which was $70.0 million, or 1.1 percent, more than anticipated. Fiscal year-to-date General Fund collections total $33.2 billion, which is $34.3 million, or 0.1 percent, below estimate. 

Board of Pharmacy ission, 

The State Board of Pharmacy has published a notice in the Pennsylvania Bulletin of the current income levels necessary for participation in the Cancer Drug Repository program. 

Independent Regulatory Review Commission 

The Independent Regulatory Review Commission (IRRC) has published a notice in the Pennsylvania Bulletin that it has received the following final form rulemaking which will be considered at its May 15 meeting.

IRRC has also published a notice in the Pennsylvania Bulletin announcing it has issued comments to the State Board of Nursing regarding its proposed rule on nursing education programs issued January 25, 2025. Find IRRC’s comments here.

  • The Philadelphia Inquirer has published an article about Independence Blue Cross’, the largest health insurer in southeastern Pennsylvania, reported financial loss in 2024 due, in part, to Medicare and Medicaid rates.

PA Health Policy Update for March 28

Special Election Update 

Two special elections occurred this week on Tuesday, March 25 to fill vacancies in the state House of Representatives and Senate. Democrat Dan Goughnour won the special election to represent House District 35, which was vacated after the passing of Representative Matt Gergely. His election sustains the Democratic one-vote majority in the House. In a surprising outcome, Democrat Jim Malone narrowly defeated Republican Josh Parsons to replace the Senate seat formerly held by Ryan Aument who resigned to work for U.S. Senator Dave McCormick. Malone’s election will narrow the Republican majority in the Senate to 27-23.

  • The House of Representatives passed a package of bills that seek to codify federal Affordable Care Act (ACA) patient protections in state statute.
    • House Bill 404, which enables an adult child to receive insurance coverage until age 26.
    • House Bill 535, which prohibits annual and lifetime coverage limits.
    • House Bill 618, which prohibits the denial of health insurance coverage due to pre-existing conditions.
    • House Bill 755, which maintains access to preventative health care services.
  • The House Aging & Older Adult Services Committee met on Monday, March 24 and favorably reported, in addition to other legislation, House Bill 372, which requires the Department of Aging to publicly release a compliance report on the Area Agencies on Aging (AAAs).
  • The House Labor & Industry Committee met on Tuesday, March 25 and favorably reported, among other bills, House Bill 926, which seeks to prevent health care workplace violence by placing several requirements on health care facilities.
  • The Senate Judiciary Committee met on Tuesday, March 25 and favorably reported, among other bills, Senate Bill 347, which prohibits the implementation of safe injection sites throughout the commonwealth, and Senate Bill 326, which amends the Controlled Substance, Drug Device, and Cosmetic Act to automatically schedule a controlled substance when one is added by the federal government and removes the Secretary of Health’s ability to reschedule a controlled substance.

The Senate will reconvene on Monday, March 31 through Wednesday, April 2. The House of Representatives is now recessed until Monday, April 7.

The Department of Human Services (DHS) has issued an updated Pennsylvania Medicaid Managed Care Directory.

DHS has issued its report on Medicaid managed care enrollment in Pennsylvania for the month of February. 

Independent Regulatory Review Commission  

The Independent Regulatory Review Commission (IRRC) has issued comments to the State Board of Nursing regarding its proposed rule on nursing education programs issued January 25, 2025. Find IRRC’s comments here.
